By accessing or using Afrivotify's online voting platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users of the platform, including campaign organizers, voters, and visitors.

2. Description of Services

Afrivotify provides an online voting platform that enables:

• Creation and management of voting campaigns
• Secure online voting through various payment methods
• Real-time vote tracking and results
• Nominee management and public campaign pages
• Email notifications and campaign analytics

3. User Accounts

Registration

To use certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

• You must be at least 18 years old to create a company account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You may not share your account with others

4. Campaign Guidelines

Campaign organizers must ensure their campaigns:

• Do not promote illegal activities or content
• Do not contain defamatory, discriminatory, or offensive material
• Do not infringe on intellectual property rights
• Comply with all applicable laws and regulations
• Provide accurate information about nominees and voting rules

We reserve the right to remove campaigns that violate these guidelines without refund.

5. Voting Rules

• Each vote must be paid for through our approved payment methods
• Vote manipulation or fraud is strictly prohibited
• Votes cannot be refunded once cast
• We reserve the right to invalidate suspicious voting activity
• Voting is only available during the campaign's active period

6. Payments and Refunds

Subscription Payments

Campaign organizers pay subscription fees based on their selected package. Payments are processed securely through M-Pesa, Paystack, or other approved methods.

Commission

Afrivotify retains a commission on votes received as specified in your subscription agreement. The remaining amount is disbursed to campaign organizers.

Refund Policy

• Subscription fees are non-refundable once a campaign has been created
• Votes once cast cannot be refunded
• Refunds may be considered in cases of technical errors on our part

7. Intellectual Property

All content, design, and functionality of the Afrivotify platform are owned by Afrivotify and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our platform content
• Use our branding without permission
• Reverse engineer or attempt to extract source code

You retain ownership of content you upload to campaigns but grant us a license to display and process it for service delivery.

8. Limitation of Liability

Afrivotify is provided "as is" without warranties of any kind. We are not liable for:

• Service interruptions or technical issues
• Loss of data or unauthorized access to your account
• Actions of other users or third parties
• Indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid to us in the past 12 months.

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees
• Provide false information

You may close your account at any time by contacting us. Termination does not entitle you to refunds for unused subscription periods.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use of our services after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
